1920-2020. Il costituzionalismo austriaco: politica, diritti e istituzioni

Nell’ottobre del 2020 saranno trascorsi esattamente 100 anni dalla promulgazione della prima costituzione democratica austriaca che sancì la nascita di una Repubblica democratica e parlamentare sulle ceneri dell’Impero asburgico. La costituzione del 1920 – che sarebbe durata appena nove anni – creò un governo di tipo parlamentare, un assetto federale e una Corte costituzionale. A partire dal caso austriaco vorremmo costruire un numero della rivista che non sia orientato solo alla analisi-discussione della costituzione austriaca ma, in senso lato, che contribuisca ad una riflessione sull’inizio della nuova età delle costituzioni democratiche cui essa – insieme a quella weimariana – dà inizio. Quali sono i principi giuridici e i valori istituzionali che tale “età” veicola attraverso proprio la Costituzione austriaca? Come interpreta tale Costituzione il sempre fondamentale problema della unità politica e del pluralismo (sociale e politico)? Perché questa nuova “età” non riesce a mantenere le promesse che reca in sé? Queste sono alcune delle domande che vorremmo provare ad affrontare attraverso contributi mirati, provenienti da discipline diverse (storia, scienza e teoria del diritto, storia delle istituzioni e delle dottrine politiche)

1920-2020: Austrian Constitutionalism: Politics, Rights and Institutions

On October 2020 there will be the centenary of the first Austrian democratic constitution, creating a federal Republic with a system of constitutional jurisdiction. The upcoming issue of our journal aims to include contributions on the first Austrian constitution and on how that constitution – along with the Weimarian one – represented the beginning of the “new era of democratic constitutions” for large part of post-war Europe. What were the main legal principles and institutional values embodied by this “new age”, just through the Austrian constitution? How did the latter interpret the key issue of the relationship between political unity and social-political pluralism? Why was the Austrian constitution not able to keep its promises, as well as this “new era”?

These are simply some of the questions and problems, which we would like address through contributions coming from history, legal science, theory of law, history of political institutions and history of political doctrines. Those who want to participate in the making of the upcoming issue are required to send their essays in one of the languages accepted by the journal to the following email address: redazione.rivistapolitica@gmail.com by June 30th 2020. Österreichischer Konstitutionalismus: Politik, Rechte und Institutionen Im Oktober sind genau einhundert Jahre vergangen, seitdem die erste demokratische Verfassung Österreichs verkündet wurde, die die Geburt einer demokratischen und parlamentarischen Republik aus der Asche des Habsburgerreichs sanktionierte.

Die Verfassung von 1920, die nur neun Jahre dauerte, schuf eine parlamentarische Regierungsform, eine föderale Struktur und ein Verfassungsgericht. Ausgehend vom österreichischem Fall möchten wir eine Ausgabe der Zeitschrift herausgeben, die nicht nur zur Analyse und Diskussion der österreichischen Verfassung orientierte Beiträge enthalten könnte, sondern (sie) auch im weiterem Sinne zu einer

Überlegung über den Beginn des neuen Zeitalters demokratischer Verfassungen beitragen würde, mit dem – zusammen mit der Weimarer Verfassung – anfängt. Welche sind die rechtlichen Grundsätze und die institutionellen Werte, die dieses „Zeitalter“ genau durch die österreichische Verfassung vermittelt? Wie interpretiert solch eine Verfassung das immer grundlegende Problem der politischen Einheit und des sozialen Pluralismus? Warum kann dieses neue „Zeitalter“ die darin enthaltenen Versprechen nicht halten? Dies sind einige der Fragen, die wir versuchen möchten, durch gezielte Beiträge aus verschiedenen Disziplinen (Geschichte, Wissenschaft und Theorie des Rechtes, Geschichte der Institutionen und der politischen Lehren) zu beantworten, die darauf abzielen, eine monografische Ausgabe zu erarbeiten.

Die Beiträge, die in einer der von der Zeitschrift zugelassenen Sprachen und gemäß den beigefügten Bestimmungen verfasst werden sollen, müssen bis zum 30. Juni 2020 an die folgende Adresse gesendet werden: redazione.rivistapolitica@gmail.com
